Entry into Force of the Polish Act of July 3, 2026, on Artificial Intelligence Systems
On August 11, 2026, the Polish Act of July 3, 2026, on Artificial Intelligence Systems entered into force. The Act implements the obligations set forth in Regulation (EU) 2024/1689 of the European Parliament and of the Council laying down harmonized rules on artificial intelligence (commonly known as the “AI Act”).
From this date, most of the Act’s provisions are in effect, including those concerning the establishment and operation of the Commission for the Development and Safety of Artificial Intelligence (KRiBSI).
It should be noted, however, that for half of the Act’s chapters and Articles 8-18 (provisions concerning the issuance of individual opinions by KRiBSI), a later effective date is provided for, namely 3 months from the date of promulgation. Consequently, on October 28, 2026, the following regulations will enter into force:
- The issuance of individual opinions by KRiBSI (Articles 8–18),
- KRiBSI’s oversight of compliance with artificial intelligence regulations (Chapter 3),
- Proceedings before the market supervisory authority (Chapter 4),
- An agreement on the conditions for extraordinary mitigation of sanctions, the conclusion of which may be authorized by a decision of KRiBSI (Chapter 5),
- Administrative fines and criminal provisions (Chapter 8),
- Amendments to the regulations (Chapter 9).
It is also worth noting the separate dates for appointing the members of KRiBSI. Article 125(2) provides for the appointment of the Chair of KRiBSI within 2 months of the Act’s entry into force, i.e., October 11, 2026. Moreover, pursuant to Article 125(3), the first meeting of the KRiBSI is to be convened by the Chair within three months of the Act’s entry into force, i.e., November 11, 2026.
Article 125(4), which enters into force on the day following its promulgation (July 28, 2026), also constitutes an exception to the effective date of August 11, 2026. This provision allows for the commencement of organizational work related to the implementation of the new artificial intelligence oversight system (Article 125(4)).
The Act’s entry into force marks the culmination of many months of work on fulfilling the obligations arising from the AI Act.
