A lower amount of court fees for summons for amicable settlement in Poland
On September 28, 2023, amendments to the Law on Court Costs in Civil Cases in Poland went into effect.
According to the newly introduced Article 23a of the Law, the maximum fee for summons for amicable settlement is again PLN 300.
In recent years, the fee for financial claims was as much as one-fifth of the lawsuit fee, meaning that the maximum fee could be as high as PLN 40,000.
The change is vital in terms of protecting intellectual property rights.
The legal tool consisting in an attempt to settle a dispute before a court is often used when the infringer does not respond to out-of-court attempts to settle the dispute amicably.
The high rates of court entry fees discouraged many potential claimants from filing their motions with the court.
